This document is a legally binding, contractual
agreement between the “Buyer/Customer” and Monster
Transmission & Performance.
GOODS DAMAGED IN SHIPPING
Shipments are insured; therefore claims for damage must be made with the freight company. Do not return the merchandise to Monster Transmission & Performance unless prior arrangements have been made. Products returned freight collect will be refused and returned at customer’s expense.
SUMMARY OF TERMS & LIMITED WARRANTY
(LIMITED TO A SINGLE PRODUCT REPLACEMENT OR REPAIR)
Due to the unusual stress placed on high-performance parts and because we have no control of how they are installed, used, maintained or modified outside of our own design and construction. Monster Transmission & Performance warrants that all of its products are free from defects in material and workmanship, for a period of 30 days including transmissions that were purchased without a torque converter and/or a period of 90 days for Level 3 & Custom Built Transmissions that were purchased with a torque converter, Extended 3 year for Level 1 & Level 2 Transmissions purchased with a torque converter. All torque converters include a Standard 90 Day warranty and have an optional 1, 2 and 3 year extensions available at an additional cost. The warranty period begins from the date of delivery, NO EXCEPTIONS! We recommend that you keep your invoice or receipt because proof of purchase date is required. This limited warranty shall only cover the original purchaser. This warranty shall not be extended to any other person or transferee. This warranty only covers the product(s) purchased. If a product is determined or believed to be not as described or defective in any way, the terms & conditions of this agreement still apply. There are no refunds; you understand that under no circumstances can a refund or a credit card chargeback be issued. Chargebacks of any nature arising from a complaint or dispute lodged by the BUYER to his/her credit card company shall be deemed as a violation of this agreement. Where such chargeback occurs, the BUYER further agrees to indemnify Monster Transmission & Performance and shall be fully responsible for any fees associated with said chargebacks. All chargebacks and related fees shall be paid in full within 10 days notice to Monster Transmission & Performance. Failure to pay Monster Transmission & Performance the full amount due by these transactions shall constitute a violation of this contractual agreement and shall force the BUYER to incur any and all associated costs that secure Monster Transmission & Performance’s unhampered payment of said charges. These charges include, but are not limited to legal costs, credit card fees, and bank charges. You further agree to allow Monster Transmission & Performance to charge your credit card any and all costs associated with the collection of said costs. A signed warranty slip must be returned to Monster Transmission & Performance before any warranty service will be provided. This Limited Warranty and Terms & Conditions of Sale Agreement are subject to the laws of Florida. Any action brought or held on the basis of this Limited Warranty and/or Terms & Conditions of Sale Agreement will be brought and held in the courts located in Hernando County, Florida. The customer assumes any and all legal fees, including attorney costs for both parties, if the customer is determined to be guilty in the court of law.
PRO-RATED WARRANTY COVERAGE & SHIPPING CHARGES
(ON LEVEL 1 & 2 TRANSMISSION PACKAGES, BASED ON ORIGINAL INVOICE PRICING)
For customers that purchased a transmission and torque converter package, the warranty structure is as follows. All warranted transmissions must be accompanied by the torque converter for inspection purposes.
Monster Transmission will cover the specified shipping charges below on a single warranty claim.
Within the first 90 Days
Monster Transmission will ship a replacement transmission first, then schedule a pickup for the original product(s)
within 30 days and cover all shipping charges.
Within the 3-12 Month Period
The customer must return the defective transmission
freight pre-paid for inspection. Monster Transmission
will then pay shipping on the replacement transmission.
Pro-Rated 12-24 Months
Customer may return the transmission freight
pre-paid and receive a 75% discount on the replacement
transmission. If the customer elects not to return the
defective transmission, they will be offered a 65%
discount on a replacement transmission.
Pro-Rated 24-36 Months
Customer may return the transmission freight pre-paid and receive a 50% discount on the replacement transmission. If the customer elects not to return the defective transmission, they will be offered a 40% discount on a replacement transmission.
TERMS OF SALE/LIMITED WARRANTY DOES NOT COVER ANY OF THE FOLLOWING:
Any and all freight damage claims. Fluid, Rental cars, loss of work, any labor costs, removal/reinstall fees, towing costs, inspection fees and any other incidental costs or damages which may be associated with product failure. Any product that has been physically altered, improperly installed or maintained. Any product used in an improper application, abused or not used in connection with the proper parts. Any product that is defective due to accident, neglect or unauthorized repair. Any product where proper cooling and/or fluid levels have not been maintained. Any product that contains broken parts or external damage. There is no implied warranty of merchantability or fitness for a particular purpose. Monster Transmission & Performance’s obligation under this warranty is limited to the repair or replacement of its products by a Monster Transmission & Performance facility. There are no warranties that extend beyond the description on the face of this warranty. This warranty is subject to the following: rebuilding of transmissions will be limited to replacement of all friction materials, gaskets and seals. There will be an additional charge for parts that are damaged as a result of items not covered by this warranty.
TERMS OF SALE/LIMITED WARRANTY IS VOID IF THESE REQUIREMENTS ARE NOT MET:
Transmission cooler lines must be flushed to avoid using old oil or metal shavings from previous transmission. High-performance and towing applications must install an auxiliary transmission oil cooler. TV Cable (for transmissions that have one) must be adjusted properly for adequate function of the transmission. All transmissions must be installed, adjusted and maintained by an experienced certified transmission technician. Transmission oil and gear oil must be filled prior to installation. Any and all repairs or tampering made to a product by the customer or an agent acting on behalf of the customer without prior written authorization by a Monster Transmission & Performance representative will void this warranty. Transmission & Torque Converter orders that receive a warranty longer than 90 Days, must have the transmission/torque converter serviced every 12 months or 12,000 miles, whichever occurs first. When filing a warranty claim you must provide a copy of your service receipt(s) to show proof that the product(s) have been properly maintained. This includes, but is not limited to, transmission/converter fluid flush and change. Any claim that cannot provide a legitimate, dated, service sales receipt will void any and all warranty coverage.
The warranty
becomes null & void once any transmission is installed
in conjunction with a used torque converter. Monster
Transmission reserves the right to deny warranty
coverage if the issue is believed not to be manufacturer
related.
PRODUCT EXCHANGE
Within the first 90 days, if a transmission replacement has been sent and the original transmission is not returned within 30 days, the customer will be charged full price for the new transmission. If a product does not remain operational for the full warranty period then upon return of the defective product shipping pre-paid to Monster Transmission & Performance by the original purchaser, Monster Transmission & Performance will provide a product exchange. If a product is incorrectly ordered or you have received an incorrect product, it is the sole responsibility of the purchaser to return the product for an exchange. The original purchaser is responsible for all shipping costs. Monster Transmission & Performance reserves the right to inspect defective products before an exchange is made. The Buyer/Customer gives full authorization to Monster Transmission & Performance to first charge their credit card that is on file if one is available, or secondly, mail an invoice for any shipping cost and/or parts that are not covered by this agreement.
MERCHANDISE RETURNS
All returns are subject to a 25% restocking fee. Special orders, special order deposits and down payments are not refundable. A warranty form (packaged with each product) must be signed and returned within 30 days from the original date of purchase for the warranty to be valid. No returns or adjustments to billing after 30 days on any products. There are absolutely no refunds, only product exchange will be offered for any and all returns. In order to provide better customer service, we require prior approval before a customer returns merchandise for warranty or for other reasons. To obtain a Return Material Authorization (RMA) number, please log-on to the Monster Transmission & Performance website and fill out a Support Ticket. All merchandise returned should be sent freight prepaid and insured, and delivered to the following address: 13743 Linden Dr., Spring Hill, FL, 34609. Monster Transmission & Performance is not liable for any taxes or duties associated with international shipments. Items returned for credit within the 30 days of original purchase date must be in perfect, un-used condition. Orders cancelled prior to shipping are subject to a 10% restocking fee. There are no returns on custom built products.

orders are bound by the agreement received at the time
of purchase.
